These Terms of Use (“Terms”) govern your access to and use of the websites and online services operated by [PACK PET CARE LEGAL ENTITY NAME] (“Pack Pet Care”) on which these Terms are posted (collectively, the “Site”). BY ACCESSING OR USING THE SITE, YOU (“YOU”) AGREE THAT YOU HAVE READ AND UNDERSTAND THESE TERMS. IF YOU DO NOT AGREE WITH THESE TERMS, DO NOT ACCESS OR USE THE SITE. We may modify these Terms at any time.  All changes will be effective immediately upon posting to the Site.  Material changes will be conspicuously posted on the Site or otherwise communicated to you.  By using the Site after changes are posted, you agree to those changes.

 

  1. YOU MUST BE AT LEAST EIGHTEEN (18) YEARS OLD TO USE OUR SITE. BY ACCESSING, USING AND/OR SUBMITTING INFORMATION TO OR THROUGH OUR SITE, YOU REPRESENT THAT YOU ARE NOT YOUNGER THAN 18. IF YOU ARE THE PARENT OR LEGAL GUARDIAN AND CONSENT TO YOUR MINOR CHILD’S ACCESS TO AND USE OF OUR SITE. YOU AGREE TO BE BOUND BY THIS AGREEMENT ON BEHALF OF YOURSELF AND YOUR MINOR CHILD.

  2. Content.  The Site, including its text, audio, video, graphics, charts, photographs, interfaces, icons, software, computer code, data, trademarks, logos, slogans, documentation, other components and content, and the design, selection, and arrangement of content, and all intellectual property rights in the foregoing (collectively, the “Content”) are exclusively the property of Pack Pet Care or, as applicable, its vendors or licensors.  Except for the rights expressly granted to you in the next section, Pack Pet Care reserves all other rights in and to the Site and Content, including all intellectual property rights.

  3. Use Rights.  You may only use the Site and Content for your personal, non-exclusive use in the United States, so long as you comply with these Terms and all other terms posted throughout the Site as applicable to you (if any), and all applicable laws. You may only use the Site and the Content for their intended purposes for which they are made available to you by Pack Pet Care.

  4. Use of Marks.  Pack Pet Care owns certain trademarks, names, logos, insignia, or service marks (“Marks”).  You do not have the right to use any Marks except as expressly agreed to in writing by Pack Pet Care.  In addition, the Site may contain third-party marks and third-party copyrighted materials, which are the property of their respective owners.  Nothing in these Terms grants to you any rights in or to those third-party marks or materials without such third-party’s consent.

  5. Intellectual Property Rights.  The Site and Content are protected by copyright, trademark, and other intellectual property laws.  Any unauthorized use of any trademarks, trade dress, copyrighted materials, or any other intellectual property belonging to Pack Pet Care or any third party is strictly prohibited and may be prosecuted to the fullest extent of the law.

  6. Compliance with Laws.  In connection with your access to and use of the Site, you are responsible for complying with all applicable laws, regulations, and rules of all relevant jurisdictions, including all applicable rules regarding online conduct.

  7. Restrictions on Your Use of the Site.

    • You will not copy, duplicate, sell, publish, post, license, rent, distribute, modify, translate, adapt, reverse-engineer, or create derivative works of the Site or Content without Pack Pet Care’s prior written consent.

    • You will not use the Site for unlawful purposes.

    • You will not submit inaccurate, incomplete, or out-of-date information via the Site, commit fraud or falsify information in connection with your use of the Site.

    • You will not engage in data mining or similar data gathering or extraction activities from the Site. You will not use the Site to harvest email addresses, names, or other information of the users of the Site or to spam other users of the Site.

    • You will not access, use, or copy any portion of the Site or Content, through the use of indexing agents, spiders, scrapers, bots, web crawlers, or other automated devices or mechanisms.

    • You will not use the Site to post, transmit, input, upload, or otherwise provide any information or material that contains any viruses, worms, Trojan horses, malware, ransomware, adware, or other harmful computer code that may disable, damage, impair, or otherwise interfere with the Site, the servers used to make the Site available, or any other network, computers, hardware, software or systems.

    • You will not engage in activities that aim to render the Site or associated services inoperable or to make their use more difficult.

    • You may not frame, mirror, or circumvent the navigational structure of any part of the Site.

    • You may not engage in any conduct while using the Site that Pack Pet Care considers inappropriate, unauthorized, or contrary to the intended purpose of the Site.

  8. Feedback and Other Content Submitted By You.  If you submit comments or feedback to us regarding the Site or its Content, or any other comments, questions, requests, content or information that is not personal information (“Feedback“), we may use any comments and feedback that you send us in our discretion and without attribution or compensation to you.

  9. Social Media.  Links to Pack Pet Care’s social media pages (e.g. Facebook, Twitter (or X), LinkedIn, and YouTube) are included on the Site (“Social Media Pages“).  Because anyone may post or tag on Social Media Pages, posts do not necessarily reflect Pack Pet Care’s views.  We reserve the right to remove anything from our Social Media Pages, in our sole discretion.  We may also take steps to block users from access to our Social Media Pages who violate these Terms.  If we follow, like, favorite, share, or re-post an individual’s content on our Social Media Pages, that is not an endorsement by Pack Pet Care of that third party or any service or company they represent.

  10. Informational Use Only. The information and Content available on the Site are provided for general informational and marketing purposes only. Nothing on the Site constitutes veterinary, medical, legal, or other professional advice, and Site content is not intended to replace advice, diagnosis, or treatment from a licensed veterinarian or other qualified professional. You are responsible for determining whether any information on the Site is appropriate for your pet and circumstances. Descriptions of our pet care services, capabilities, benefits, or anticipated outcomes are provided for general informational purposes and do not guarantee any particular result. The information on the Site does not replace, modify, or supersede any separate agreement, policies, or other terms applicable to services you purchase or receive from Pack Pet Care.

  11. NO WARRANTY.  THE SITE AND CONTENT ARE PROVIDED “AS IS,” “AS AVAILABLE,” AND WITHOUT ANY WARRANTY OF ANY KIND.  TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PACK PET CARE EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND WITH RESPECT TO THE SITE AND CONTENT, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM STATUTE, SUCH AS COURSE OF PERFORMANCE, COURSE OF DEALING OR USAGE IN TRADE.

    PACK PET CARE MAKES COMMERCIALLY REASONABLE EFFORTS TO ENSURE THAT ALL CONTENT ON THE SITE IS ACCURATE AND RELIABLE, BUT NEITHER ACCURACY NOR RELIABILITY ARE GUARANTEED.  PACK PET CARE DOES NOT WARRANT OR GUARANTEE THE QUALITY, COMPLETENESS, TIMELINESS, OR AVAILABILITY OF THE SITE OR CONTENT.  PACK PET CARE DOES NOT WARRANT OR GUARANTEE THAT THE SITE OR CONTENT WILL BE UNINTERRUPTED OR ERROR-FREE, THAT ANY DEFECTS IN THE SITE OR CONTENT WILL BE CORRECTED, OR THAT THE SITE OR THE SERVERS THAT MAKE THE SITE AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL CONDITIONS OR COMPONENTS.

    WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, WE DO NOT WARRANT OR ENDORSE ANY THIRD-PARTY CONTENT.

  12. LIMITATION OF LIABILITY.  TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL PACK PET CARE OR ITS DIRECTORS, OFFICERS, OWNERS, EMPLOYEES, CONTRACTORS, REPRESENTATIVES, CONSULTANTS, VOLUNTEERS, AGENTS, SUPPLIERS, ATTORNEYS OR LICENSORS (TOGETHER, “PACK PET CARE PARTY(IES)”) BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL LOSS OR DAMAGE, ARISING OUT OF OR IN CONNECTION WITH THE SITE OR CONTENT, OR YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SITE OR CONTENT, REGARDLESS OF THE FORM OF ACTION, WHETHER THE CLAIM IS BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, WARRANTY, OR OTHERWISE, AND EVEN IF A PACK PET CARE PARTY HAS EXPRESS KNOWLEDGE OF THE POSSIBILITY OF THE LOSS OR DAMAGE.

    YOUR SOLE AND EXCLUSIVE REMEDY IS TO STOP ACCESSING AND USING THE SITE OR CONTENT.

    WITHOUT LIMITING THE FOREGOING, IN NO EVENT WILL THE AGGREGATE LIABILITY OF THE PACK PET CARE PARTIES ARISING OUT OF OR IN CONNECTION WITH THE SITE OR CONTENT, OR YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SITE OR CONTENT EXCEED $100 U.S.D., EVEN IF ANY REMEDY PROVIDED FAILS OF ITS ESSENTIAL PURPOSE.

    SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE EXCLUSIONS AND LIMITATIONS MAY NOT APPLY TO YOU.

  13. INDEMNIFICATION.  YOU SHALL INDEMNIFY, DEFEND AND HOLD HARMLESS THE PACK PET CARE PARTIES FROM AND AGAINST ALL LOSSES, CLAIMS, LIABILITIES, DEMANDS, COMPLAINTS, ACTIONS, DAMAGES, JUDGMENTS, SETTLEMENTS, FINES, PENALTIES, EXPENSES, AND COSTS (INCLUDING WITHOUT LIMITATION REASONABLE ATTORNEYS’ FEES) THAT ARISE OUT OF OR IN CONNECTION WITH (A) YOUR VIOLATION OF APPLICABLE LAWS, (B) YOUR MISUSE OF THE SITE OR ANY CONTENT, AND (C) YOUR BREACH OF THESE TERMS OR ANY OTHER TERMS ON THE SITE.  WE RESERVE, AND YOU GRANT TO US, THE EXCLUSIVE RIGHT TO ASSUME THE DEFENSE AND CONTROL OF ANY MATTER SUBJECT TO INDEMNIFICATION BY YOU (SUBJECT TO YOUR CONTINUING INDEMNIFICATION).

  14. Third-Party Websites and Content.  The Site may link to, or be linked to, websites not maintained or controlled by Pack Pet Care.  Those links are provided as a convenience to the visitors of our Site.  Pack Pet Care is not responsible for examining or evaluating the content or accuracy of third-party websites linked through the Site.  Pack Pet Care does not warrant or endorse any third-party website or any products or services made available through those websites.  When leaving the Site, it is the terms and privacy notice of that third party that govern your use of the third-party site (and such third-party’s use of your personal information), not these Terms.

    The Site may also contain certain third-party content. We provide third-party content for your convenience, not as an endorsement.  The presence of third-party content does not mean that Pack Pet Care has reviewed the third-party content or that there is any association between Pack Pet Care and any third party.  You access third-party content at your sole risk. Pack Pet Care has no responsibility for any third-party content.  Nothing in these Terms grants you any rights to any third-party content.

  15. Linking to the Site. You are prohibited from linking to the Site on your website or elsewhere without the prior express written consent of Pack Pet Care.  If Pack Pet Care grants you a right to link to the Site, certain terms may apply, and Pack Pet Care reserves the right to revoke such consent at any time.  You are responsible for any costs incurred by Pack Pet Care in enforcing its rights under this Section.

  16. Termination.  If you violate applicable laws or these Terms, you are immediately prohibited from further use of the Site or Content, and we may restrict your access to the Site or Content.  Pack Pet Care may suspend or terminate the Site or any Content, in whole or in part, at any time in its sole discretion for any reason.  Pack Pet Care shall not be liable to you or anyone else for any damages arising from or related to Pack Pet Care’s suspension or termination of your access to the Site or the Content, or in the event Pack Pet Care modifies, discontinues or restricts the availability of the Site or the Content (in whole or in part).

  17. Site Unavailability.  Without limiting the generality of the previous section, the Site or Content may be unavailable or limited for various reasons, and we shall not be liable to you for any such unavailability, including without limitation (a) hardware, software, server, network, or telecommunications failures, (b) severe weather, war, riot, act of God, fire, earthquake, strike, labor shortage, etc., (c) regulatory restrictions and other acts of government, (d) interruptions due to utility and power companies, and (e) interruptions due to hacking or other malicious intrusion.

  18. Cooperation with Law Enforcement.  Pack Pet Care will cooperate with law enforcement if you are suspected of having violated applicable laws.  YOU WAIVE AND HOLD PACK PET CARE AND THE PACK PET CARE PARTIES HARMLESS FOR ANY COOPERATION WITH, OR DISCLOSURE OF YOUR INFORMATION TO, LAW ENFORCEMENT RELATING TO YOUR SUSPECTED VIOLATION OF APPLICABLE LAWS.

  19. Governing Law and Dispute Resolution. These Terms will be governed by and construed, interpreted, and enforced in accordance with the laws of the State of Georgia without reference to its conflicts or choice of law principles. Any arbitration or court proceeding will take place in Fulton County, Georgia and you hereby consent to the exclusive jurisdiction and venue of the state or federal courts in Fulton County, Georgia. You irrevocably submit and consent to the personal jurisdiction of such courts. Any cause of action or other claim brought by you with respect to the Site or Content must be commenced within one year after the cause of action or claim arises.

  20. Assignment.  We may assign our rights and delegate our duties under these Terms at any time to any party without notice to you.  You may not assign your rights or delegate your duties under these Terms without our prior written consent.  These Terms inure to the benefit of Pack Pet Care’s successors and assigns.

  21. Entire Agreement.  These Terms and any other terms posted throughout the Site (if any) are the entire agreement between you and Pack Pet Care with respect to your access to and use of the Site.
  22. Waiver.  Pack Pet Care’s failure to enforce any provision of these Terms will not constitute a waiver of that provision or any other provision.  Any waiver of any provision of these Terms will be effective only if in writing and signed by Pack Pet Care.

  23. Severability.  If any provision of these Terms is held invalid, void, or unenforceable, that provision will be severed from the remaining provisions and the remaining provisions will remain in full force and effect.  The headings in these Terms are for convenience only and do not affect the interpretation of these Terms.

  24. Electronic Communications.  These Terms and any other documentation, agreements, notices, or communications between you and Pack Pet Care may be provided to you electronically to the extent permissible by law.

1. Acceptance of These Terms

These Terms of Use (“Terms”) are a binding agreement between you and [LEGAL ENTITY NAME], doing business as Pack Pet Care (“Pack Pet Care,” “we,” “us,” or “our”). By accessing or using the Website, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Website.

2. About Pack Pet Care and This Website

Pack Pet Care is a family of local pet-care businesses offering dog daycare, boarding, grooming, and training, and it partners with owners of established pet-care businesses. This Website provides information about Pack Pet Care, helps visitors find a local Pack business, and lets business owners start a conversation with us about a potential partnership.

The Website is not a booking platform, and we do not provide pet care through it. Daycare, boarding, grooming, training, and related services are provided by the individual local businesses in the Pack, under their own names, websites, and agreements. Reservations, vaccination and behavior requirements, fees, cancellations, and liability waivers for those services are governed by that business’s own terms, not by these Terms. If these Terms conflict with a local business’s terms for its services, the local business’s terms control for those services.

3. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Website. The Website is not directed to children under 13, and we do not knowingly collect personal information from them. If you use the Website on behalf of a company, you confirm that you have authority to bind that company to these Terms.

4. Use of the Website

You may use the Website only for lawful purposes and in line with these Terms. You agree not to:

  • violate any applicable law or regulation through your use of the Website;
  • submit false or misleading information, submit another person’s information without permission, or impersonate any person or business;
  • try to gain unauthorized access to the Website, our servers, or any connected systems, or interfere with the Website’s operation or security;
  • upload or transmit viruses, malware, or any other harmful code;
  • use bots, scrapers, or other automated tools to collect content or data from the Website, other than standard search-engine indexing;
  • copy, reproduce, or use Website content for commercial purposes without our written permission; or
  • use the Website to send spam or unsolicited advertising, or to harass anyone.

5. Business Owner Inquiries

The Website invites owners of pet-care businesses to start a conversation with us about a possible partnership. If you submit an inquiry, the following applies.

  • No offer or obligation. Statements on the Website about our approach, offers, valuation, or deal structures are general descriptions. They are not an offer to buy, invest in, or partner with any business. Neither you nor we are obligated to continue discussions or complete a transaction unless and until both sides sign a definitive written agreement.
  • No guarantee. We do not promise any valuation, price, terms, timeline, or outcome.
  • We describe these conversations as confidential and handle inquiry information in line with our Privacy Policy. These Terms do not, however, create a separate non-disclosure agreement. If you plan to share sensitive financial, customer, employee, or trade-secret information, please ask us to sign a mutual non-disclosure agreement first, and hold that information back until it is signed.
  • No advisory relationship. Pack Pet Care is not your broker, attorney, accountant, or financial advisor, and nothing on the Website or in our conversations is legal, tax, or financial advice. You should rely on your own advisors when evaluating any transaction.

6. Contact Forms and Email Updates

When you contact us or sign up for updates, you agree to provide accurate information, such as your name, email address, and city. By signing up for Pack Pet Care updates, you consent to receive emails from us about Pack Pet Care news and locations. You can unsubscribe at any time using the link in any email or by writing to hello@packpetcare.com. We may still send you non-promotional messages, such as a reply to your inquiry.

Do not use our contact form for questions about your pet’s care or for emergencies. For care questions, contact your local Pack business directly. For a medical emergency, contact a veterinarian right away.

7. Local Pack Websites and Third-Party Links

The Website links to websites run by individual Pack businesses and by third parties, such as LinkedIn. Those websites have their own terms and privacy policies, and we do not control them. We are not responsible for their content, services, or practices, and a link is not a guarantee of anything on the linked site. Please review the terms and policies of any site you visit.

8. Information on the Website

The Website is for general information only. Figures such as review ratings, review counts, pets served, and number of locations are approximate, are accurate only as of the time they were published, and may change. Testimonials reflect the personal views of the people quoted and are not a promise that you will have the same experience or results. Statements about future locations or expansion are plans, not commitments, and may change.

Nothing on the Website is veterinary advice. For questions about your pet’s health or behavior, please consult a licensed veterinarian.

9. Intellectual Property

The Website and its content, including text, graphics, logos, photographs, videos, design, and software, are owned by Pack Pet Care, its affiliated businesses, or its licensors and are protected by copyright, trademark, and other laws. “Pack Pet Care,” our logo, and the names and logos of the local Pack businesses are trademarks of Pack Pet Care or their respective owners.

We grant you a limited, non-exclusive, non-transferable, revocable license to view the Website and its content for your personal or internal business use. No other rights are granted. You may not use our trademarks, or copy, modify, distribute, or create derivative works from Website content, without our prior written permission.

10. Your Submissions

“Submissions” means anything you send us through the Website, including inquiries, messages, suggestions, and other feedback. You keep ownership of your Submissions. You give us a non-exclusive, worldwide, royalty-free license to use, reproduce, and process them to respond to you, to operate and improve the Website and our services, and to evaluate potential partnerships, subject to Section 5 and our Privacy Policy. We may use any feedback or suggestions you give us about the Website or our services without obligation or payment to you. You confirm that you have the right to make each Submission and that it does not violate anyone else’s rights or any law.

TO THE FULLEST EXTENT PERMITTED BY LAW, PACK PET CARE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE WEBSITE OR THESE TERMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE WEBSITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

This Section applies to your use of the Website. Claims relating to pet-care services are governed by the terms of the local Pack business that provided those services. Some jurisdictions do not allow certain limitations of liability, so parts of this Section may not apply to you.

14. Indemnification

You agree to defend, indemnify, and hold harmless Pack Pet Care and its affiliates, officers, employees, and agents from any claims, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of your violation of these Terms, your Submissions, or your misuse of the Website.

15. Suspension and Termination

We may suspend or end your access to the Website at any time, without notice, if we believe you have violated these Terms or are using the Website in a way that could harm us, other users, or third parties. Sections that by their nature should survive termination, including Sections 5, 9, 10, and 12 through 18, will survive.

16. Governing Law and Venue

These Terms and any dispute arising out of or relating to them or the Website are governed by the laws of the State of [GEORGIA], without regard to its conflict-of-laws rules.
